Who you are contracting with

Definitions

"We" and "us" mean Bird Spikes Company. "You" means the person or organisation placing the order. "Goods" means the products you have ordered.

Orders

Placing an order is an offer to buy. That offer is accepted when we dispatch the goods, and that is when the contract is made. If we cannot supply something you have ordered we will tell you and refund you in full.

Prices and payment

Prices are shown in New Zealand dollars and are the amount you pay for the goods. Delivery, where it applies, is shown separately at checkout before you pay.

Payment is due in full at checkout and is taken through Stripe or PayPal. We never receive or store your card details.

Delivery terms, costs and timeframes are set out on the shipping page and form part of these terms.

Returns

Your rights if something is faulty, and our own change of mind policy, are set out on the refunds and returns page and form part of these terms.

Use of the products

Our products are supplied for you or your contractor to install. We do not install anything. Work at height carries real risk and is your responsibility to carry out safely or to have carried out by someone equipped for it.

You are responsible for checking that what you fit is lawful and permitted where you are fitting it. In New Zealand, native birds are absolutely protected under the Wildlife Act 1953 along with their nests and eggs. Consent may also be required for work on a listed or heritage building, and a shared boundary fence may need your neighbour's agreement.

Your consumer rights

The Consumer Guarantees Act 1993 and the Fair Trading Act 1986 apply to sales to consumers in New Zealand, and nothing in these terms limits or excludes them.

Where goods are supplied for the purposes of a business, the parties agree that the Consumer Guarantees Act 1993 does not apply, as section 43 of that Act permits.

Governing law

These terms are governed by New Zealand law and the New Zealand courts have jurisdiction. A consumer claim can be taken to the Disputes Tribunal.
